Case studies

Problems we are typically brought in to solve

Each scenario shows a point that often reduces or delays a claim, and how it can be handled.

    Warehouse · Flood

    Payout reduced for under-insurance

    Situation
A finished-goods warehouse flooded after a storm. Stock on the day of loss was far above the sum insured declared at the start of the year.
    Issue
The insurer proposed applying average, significantly reducing the settlement.
    How we help
We checked the stock declaration clauses, compiled monthly records to prove actual values and proposed a calculation consistent with the policy.
    What to do beforehand
Where stock fluctuates seasonally, use a periodic declaration basis rather than a fixed annual sum insured.

    Cargo · Sea freight

    Container damaged on arrival

    Situation
Imported machinery was dented and water-damaged when the container was opened at Cat Lai port.
    Issue
The consignee had no joint survey with the carrier and the claim deadline was close.
    How we help
We guided the loss documentation, sent the notice of claim to the carrier on time and ran the insurance claim and third-party recovery in parallel.
    What to do beforehand
Note reservations on the delivery receipt as soon as anything looks wrong, and notify the carrier in writing as early as possible.

    Construction · CAR

Dispute over the cause of a site incident

    Situation
A diaphragm wall collapsed after heavy rain, affecting neighbouring buildings.
    Issue
The insurer argued the cause was faulty design, an excluded peril.
    How we help
We worked with engineers on cause analysis, checked the exclusion and extension clauses and prepared the technical arguments for the adjuster.
    What to do beforehand
Keep site diaries, monitoring data and stage acceptance records. They are the key evidence in any argument about cause.

    Erection · EAR

    Transformer failure during commissioning

    Situation
A power project's transformer failed during testing, damaging connected equipment.
    Issue
The insurer declined the whole claim as a manufacturer's defect.
    How we help
We separated the cost of replacing the defective part (usually excluded) from resulting damage to other items (which may be covered under the wording) and rebuilt the calculation item by item.
    What to do beforehand
Read exactly how the defective design and material exclusion is worded: what is excluded and what remains covered differs between standard wordings.

    Factory · Business interruption

BI cover in place but no way to calculate it

    Situation
A main switchboard fire stopped production for several weeks. The policy included business interruption cover.
    Issue
The company had no gross profit figures on the policy's definition; the first estimate was far below the actual loss.
    How we help
We built monthly revenue and output figures, identified fixed costs still payable and extra costs to keep operating, presented on the policy's definitions.
    What to do beforehand
When buying BI cover, set the sum insured with your accountant using the policy's own definition of gross profit.

    Fleet · Road accident

Recovering the uninsured part of a loss

    Situation
A company truck was hit by another vehicle at fault. Own-damage cover paid the repair costs.
    Issue
The company still bore the deductible and lost income while the truck was off the road, and did not know if these could be recovered.
    How we help
We compiled the authorities' report, deductible records and lost operating income, claimed against the at-fault party and their liability insurer, coordinated with the insurer's subrogation.
    What to do beforehand
Keep every report and cost record after an accident even when insurance pays, because the uninsured part can still be recovered.
